A survey was published in the Archives of Internal Medicine after an article from the Associated Press opened that door to the idea of doctors that over test patients in order to avoid medical malpractice suits in the future.
The Archives surveyed 1,231 doctors including surgeons, specialists, and primary care doctors and asked two questions: Do doctors order more tests to be done on patients in order to protect themselves from malpractice suits and do they think that doctors need more protection in order to prevent the overtesting of patients.
Ninety-one percent of doctors said yes to both of the questions and more male doctors then female doctors said yes. This defensive medical approach costs the U.S. millions in health care costs each year.
